    Depends on the situation.
    If you're already known by the cops for being an asshole, probably so.
    If not, you're at the mercy of the cop's decision.

    Edit: Oh, and if you get away before you get caught, no, you won't get arrested.

    the way freedom of speech works, u would be charged for assault unless of course he hit u first. then it becomes a hate crime on the basis that he assaulted you, and u defended yourself, from a physical attack based on your known or percieved sexuality. at least in Canada anyways.

    Yes, you'd get arrested for assault. Name-calling isn't a crime in most states.
    But that's assuming you get caught. Most fights aren't reported, especially by the instigators.

    But I have to say that if you're going to throw down with a guy just because he called you a fag, you better know what you're doing. It's generally a bad idea to get in a fight with total strangers. The other guy might be a skilled fighter, or maybe he's got a weapon, or maybe he's just plain crazy.

    Just remember: The other part of "manning up" is knowing when to pick your battles.

    i dunno if it's really worth it to fight over someone calling you a faggot.. i mean, obviously let him know he's an idiot, but don't be the one to throw the first punch.
    i know a guy that got in a fight and he punched the dude and... the guy died. one punch. years in jail and a record. its not like its something that happens all the time but he didn't think that would happen.

    depends on the state, and the circumstances. If he invites you into a fight, then it is mutually agreed and there is no assault. If he doesn't and you strike him without physical provocation, you are guilty of an assault. I'm not sure any state would uphold being called a faggot as a hate crime. There you have it, in a nutshell, personally, if I had to respond to a call such as this, I'd either tell you both to grow the fuck up or throw both your asses in jail and let the da figure it out. That cools a situation quite quickly and you'll find many LEO's feel the same way....keithicon_cool.gif

    I won't sink to that level. With that type of behavior and mentality you can tell what type of individual you're dealing with. Not worth my time, but if he continues and invades my personal space and push, I 'll push back.

    Ive never been in a situation where someone has openly been agressive toward me for my sexuality, however I'd stand up for myself, but I'm not going to instigate physical violence. With that said, I'm also going to defend myself if they attack me.

    Yes, you could be arrested. You would then have a criminal record of assault possibly causing you to lose your job and being a detriment to finding another job. Besides possible jail time, if you hurt him bad enough you could be paying his medical bills and maybe pain and suffering.
    This question kind of worries me. Most people who engage in this type of violence, have poor self control and simply lose it in a situation like you describe. It is a completely different psyche to be to be sitting home and thinking about using violence when it has not been used against you first.

    Just wanted to say if you hit him it is battery not assault. Assault is when you believe they can and will hit you, and battery is the actual act of hitting. Just clarifying. Also rarely will courts allow "fighting words" to be a justification for you initiating the fight.

    Well, I know martial arts and also has pepper spray.

    I have to defend my life safety. In case, most of you don't know, being called a faggot IS a hate crime because you are already in danger of assault from that person and it's considered a cautionary response/reflex to defend yourself.

    I will probably go like "What the fuck did you just say? Did you just call me a faggot?" and if he continues to persist then I know that I have someone who's going to put my life in danger. And I won't probably stay around for the police to arrive anyway.

    What if I were a woman? Would that still considered an assault? see, now I got you thinking...Women can defend themselves, why can't the gays?
