Or they don't have it.
Or- (again)- they lie.
*Remember: Lying about your HIV status is a crime
It is getting really annoying that all the blame is put on men who have HIV and lie. It is time for men who engage in bareback sex who are negative to take accountability for their actions as well.
And besides, trying to prove that your one time New Year's trick gave you HIV and taking him to court will only cause a lot of people a lot of aggravation. Proving that just one person gave you HIV when you whored it up and chose NOT to use protection with basically someone you only knew for a few short hours will put all the scrutiny on you and YOUR behavior. Not the person who has HIV.
I had a friend exposed to HIV - thankfully he was treated in time and did not become positive, however, whilst discussing it I asked if he had inquired, at all, about the other person's sexual habits. Did you ask if they had been tested recently? Did you ask, or make any mention, about the risks or any kind of misgivings you might have (i.e. I'm neg, get tested regularly, looking to stay that way - yourself?)?
Biggest question - DID YOU USE A CONDOM? (obviously not)
Everyone likes to blame everyone else but them self when it comes to misfortunes and poor decisions. At the end of the day, yes, the person you're having sex with should be responsible enough to tell you if they have HIV. But if you don't ask, or if they don't know...if you don't protect yourself...no one's going to do it for you.
While I can understand a top having misgivings about using a condom, my answer, if met with a negative response to my "I use condoms" stance, is a negative response to someone who has "issues" using a condom.
As a bottom there is ABSOLUTELY NO FUCKING REASON WHY YOU SHOULDN'T MAKE THE TOP USE A CONDOM. It doesn't "feel better" for a bottom, it makes absolutely no fucking difference, and you're playing with your life.
1 hour of rockin sex does not make up for what you go through once you're infected. There are people with HIV who live healthy, full lives, but it's NOT easy, and it's not worth it.
Like, at all.
