    "Special Agent Richard Toth of the Air Force Office of Special Investigations at McConnell testified last year that military authorities found out about Gutierrez's sexual activities through numerous interviews with his wife, who was apparently concerned that her husband was not telling his sexual partners of his HIV status. Gutierrez's wife videotaped some of his sexual encounters.

    His commander, Maj. Christopher Hague, testified last year that he gave Gutierrez a written order in October 2009 requiring him to use condoms and to notify his sexual partners of his HIV status before engaging in sex. Gutierrez signed the order acknowledging he had received it, Hague said."

    Did Air Force know he is positive? Why did he allow him in the base?
    What If he were gay?

    Did Air Force know he is positive?
    Yes, because his commander gave him an order requiring him to tell his sexual partners that he was HIV positive.

    Why did he allow him in the base?
    Why wouldn't they? He is a serving member of the Air Force.

    What If he were gay?
    Had he been gay, he could well have been discharged from the service (for being gay, not HIV+). In any case, I imagine discharges for homosexuality have now been placed in abeyance, pending implementation of the DADT repeal. Once the DADT repeal has been fully implemented, commanders will be required to treat gay service members the same as they treat straight ones.

    DoD Policy can bar someone with HIV/AIDS from entering service, but they cannot discharge them if they contracted it after they've entered service.

    We are required to provide blood samples for HIV/AIDS testing a minimum of every two years and positive results are reported to the commander in which they must notify their troop of the status. They are also legally required to counsel them on notification of sexual partners - past, present and potential - and to require them to use protection.

    There have been cases where even military heterosexuals were infecting sexual partners and not telling them of their positive status. It happened in my last unit and people were freaking out because he was sleeping with men and women, including some of the people he was working with.

    It's not an issue of sexual orientation.

    And it sounds like he might enjoy this court martial.

    We've heard all about it for months.....

    It does seem odd... many think it is because he's "straight" and sidestepped
    some of the policies that would have excluded him from the military.

    And if he were gay.... he would have been gone.. long ago.

    Wonder how it would of been looked at if he was a bisexual?
