    This represents the typical dog and pony show of a legislative hearing, although this one is much less nuanced:

    1. How can someone consent after the act? The legislator made it sound as if one can consent before and after the act. Consent means "to permit, approve, or agree; comply or yield". Thus, it's not possible for one to consent to an act, engage in the act, and then renege the consent. That's not how it works.

    2. HIV - the physician was clearly biased because his testimony made it sound like HIV is a disease exclusive to men who have sex with men (MSM). He should have been objective in his remarks and stated that such MSM contact does contribute to a hefty 47% of the new HIV diagnoses, with the remaining 53% being attributable to injection drug use and heterosexual sex.

    3. The bias was certainly on display during this hearing:
    Legislator: "Do you have any statistics or can you give your opinion...?" (as if they are the same thing icon_rolleyes.gif)
    Physician: "... is that [answer] getting closer to what you wanted?"

    How can homosexual activity be illegal in Montana when the US Supreme Court struck down the sodomy laws as unconstitutional in 2003? This conservative lunatic is living in a 1950s era dream world. It is time for him to turn his brain ahead into the 21st century if that is possible.

    This means that they can't be enforced, but they still exist, so sodomy is still technically illegal in several states, just unenforceable. It also means that if a future Supreme Court decides that they are constitutional and overturns the Lawrence v Texas decision, they'd be re-validated.

    Some states have repealed the law since that decision (like Missouri in 2006), but others haven't.

Bills have been introduced in every legislative session since then to remove the statute along with the anti-gay language in the Health Code (e.g.: Course materials and instruction relating to sexual education or sexually transmitted diseases should include...emphasis, provided in a factual manner and from a
    public health perspective, that homosexuality is not a lifestyle

    TropicalMark, I had a good-sized mini-stroke on June 1 of last year.

    Since then, I have had three "aftershocks" which have not curtailed my resolve and daily activities (too much anyway), but has left me tired much of the time. I am now much better and able to get back my strength.

    You and I are a good pair of liberals here and we walk in lockstep regarding our beliefs, but to wish a massive stroke and pending death onto someone is stepping over the line. Sorry, but as a stroke victim myself I have to weigh in on your remarks.

    Instead, I say we pummel the bastard with a wet pillowcase filled with warm caramel pudding!!
