Wisconsin Election Surprise: David Prosser Gains 7,500 Votes After 'Human Error' In Waukesha County

    In a dramatic turn of events on Thursday, the Waukesha County clerk announced that the vote total announced for Tuesday's Wisconsin Supreme Court race had been mistaken -- and that the corrected numbers changed the outcome of the entire election.

    There were 3,456 missing votes for Democratic-backed challenger Kathleen Kloppenburg and 11,059 for incumbent GOP-backed Justice David Prosser. Kloppenburg has previously been beating Prosser by just 200 votes of the roughly 1.5 million cast statewide. The new total puts Prosser on a significant path to victory, about 7,500 votes ahead of Kloppenburg.

    Waukesha County Clerk Kathy Nickolaus announced the news in a press conference at 5:30 p.m. local time, sounding nervous and, at times, on the verge of tears. She insisted that there was no foul play in the results and blamed the mess on her own "human error."

    Nickolaus cited several reasons for the discrepancies between Tuesday night's unofficial vote totals and the new numbers. In the city of New Berlin, the total for one ward was recorded as 37 votes for Prosser, but it was actually 237, she said. In the town of Lisbon, a "typing error" resulted in both candidates losing votes. The most significant error, however, occurred in the city of Brookfield.

    "The spreadsheet from Brookfield was imported into a database that was provided by the Government Accountability Board, but it inadvertently was not saved," Nickolaus said. "As a result, when I ran the report to show the aggregate numbers that were collected from all the municipalities, I assumed that the city of Brookfield was included. It was not. The city of Brookfield cast 14,315 votes on April 5 -- 10,859 votes went for Justice David Prosser, 3,456 went for JoAnne Kloppenburg."

    "It is important to stress that this is not a case of extra votes or extra ballots being found," she added. "This is human error, which I apologize for -- which is common in this process."

    AdvertisementThe existence of the missing votes was first reported at National Review Online by Christian Schneider, a senior fellow at the Wisconsin Policy Research Institute.

    Questions were immediately raised about the new announcement. As Schneider wrote, prior to the election, Nickolaus "was heavily criticized for her decision to keep the county results on an antiquated personal computer, rather than upgrade to a new data system being utilized statewide."

    Added Schneider: "Nickolaus cited security concerns for keeping the data herself -- yet when she reported the data, it did not include the City of Brookfield, whose residents cast nearly 14,000 votes."

    The Waukesha County Board also heavily criticized the clerk after she brushed aside their recommendations for improving election security. At one point during a hearing in January, board chairman Jim Dwyer grew exasperated with Nickolaus and said, "There really is nothing funny about this, Kathy. Don't sit there and grin when I'm explaining what this is about."

    "Wisconsin deserves elections that are fair, clean and transparent," said Scot Ross, the executive director of the progressive advocacy group One Wisconsin Now. "There is a history of secrecy and partisanship surrounding the Waukesha County Clerk and there remain unanswered questions." ...

    yeah, i heard this tonight. i couldn't believe it. i just don't understand how something as important as this gets messed up. these gross mistakes are uncalled for. somebody is not doing their job.

    Yup...it is a very suspicious development.

    The Democrats ought to raise the suspicion of every non-Republican affilitated person in Wisconsin over this development...because it's just a little too coincidental that they *found* all these votes when it had seemed that the Democratic candidate had won the election!

    I have my suspicions that, had Prosser won the vote outright, these votes would never have materialized...just sayin'!

    It only confirms to me that there is a lot of fraud and crooks in
    Washington, too, and I'm going to say it again, but we thoroughly need to have an audit of every governmental department from the local level right on up to the president's office from an independent source and government reform is job number one. We can't have stuff like this happening.

    Whether this woman is a Democrat supporter or a Republican supporter, she should lose her job. This is a huge mess up!

    Well I wouldn't totally agree with that...it seems like everytime I turn on Fox, they have tons of commercials from tax attorneys who invite people to get away with paying pennies on the dollar when they owe back taxes.

    Sure...if one or two people end up paying 10% of their total tax bill, it's not a big deal...but when you have tax lawyers habitually suggesting that people who owe $10,000 or more on their taxes use a tax attorney to settle for a much lower amount, you create a whole industry committed to shortchanging the government of much needed tax revenue.

    Oddly enough, when I watch ABC, NBC or CBS, I don't see that many of these kinds of commercials. It's only when I watch Fox.

    You can't have a huge military AND foreign wars AND tax breaks for the wealthy AND a tax attorney industry set up to avoid paying taxes AND a nation with a balanced budget...it doesn't work like that!

    Wisconsinites don't like being made to look like fools. Even if this miraculous last-second election reversal stands, the hatred for Republicans will only increase. Republicans would have been better off if they had let the results of this State Supreme Court election stand. Now the numerous state-wide recall efforts against Republicans will only intensify.

    A tactical blunder for the Republicans, that may gain them a reelected State Supreme Court Justice, but lose them the whole political game. Good.

    Well even if the Democrats had won the State Supreme Court seat, does anyone really believe that the Scott Walker's agenda wouldn't have gotten passed?

    But you're right...this will raise the spectre of doubt in Wisconsin, and give the Democrats some ammunition. I suspect Scott Walker has won the battle, but will ultimately lose the war: too many problems are piling up on him to be ignored.

    Did the Republicans fix this vote?

    Are the Republicans giving plum appointments to candidates who lack appropriate qualifications on the basis of fund raising and nepotism?

    How many conversations have Koch and Walker had about the direction of Wisconsin that ordinary people don't know about?

    There's so many questions and issues to leverage over the Republicans...each new one becomes another hammer to strike them with!
