Prop 8 Case Today - listen live - 10 am PST

    [quote]
Today, the California Supreme Court will hear oral arguments in the Prop. 8 case.

Tune in this morning to watch Ted Olson argue why the proponents of Prop. 8 are unable to appeal the historic District Court decision that ruled Prop. 8 unconstitutional. The group known as “protect”marriage.com can neither demonstrate that they will suffer any harm if gay and lesbian couples are allowed to marry, nor are they government officials that represent the state.

The hearing starts at 10 a.m. PT in San Francisco and will be broadcast live at http://www.calchannel.com and on cable stations throughout California.

Although its a good fight and hopefully won. nothings really going to matter until DOMA (defense of marriage act) is ruled unconstitutional. A lot of people refuse to get married because it is still a second class marriage at the state level without any federal benefits. But obviously all small steps count. Just don't forget the WAR if the BATTLE is won.

The funny/sad part is that the last 20 years or so of right-leaning SCOTUS decisions have led to a much decreased zone of those with standing to litigate cases such as these. It's going to be ironic if/when the right is hoisted on its own petard here and ProtectMarriage isn't allowed to carry this forward.

The sad thing, though, is that if they don't have standing, then the district court ruling will probably stand but will only apply to Prop 8 and thus CA - we won't have the chance to apply this to the rest of the Ninth or the US as a whole.

As hairymj says, next target is DOMA.

    thanks for the links!

DOMA is going to be the big thing that needs to be lifted....but a win here would still be an important step forward.

Seems they are giving the yes on 8 people standing. But either way, its going to SCOTUS so this is pretty much more theater than anything else.

    I agree.
The odd part is that even if they say, "in CA, we would give them standing," that is under state law. This is a federal trial, and under recent SCOTUS precedent, ProtectMarriage doesn't have standing, as I understand it. So the 9th will have to find standing themselves, as well.
