    Wow. I knew there were some f'ed up things about Texas, but this just puts the icing on the cake...granted, I'm sure we don't know all the facts, but spit as a deadly weapon...really? icon_confused.gif

    HIV-Positive Man Sentenced to 35 Years for Spitting



    An HIV-positive man was sentenced to 35 years in prison on May 14 for spitting in the eye and mouth of a Dallas police officer in 2006, The Dallas Morning News reports (dallasnews.com, 5/15).

    While being arrested for public intoxication, 42-year-old Willie Campbell resisted, spitting in the face of Officer Dan Waller. Campbell then told the arresting officer that he was HIV positive. A second police officer claimed that Campbell had spit at him in an unrelated incident.

    The jury deemed Campbell’s saliva a deadly weapon and mandated that he serve half of his sentence before becoming eligible for parole.

    Well, they still have the death penalty in Texas so I guess you could say he was lucky.

    Obviously, he didn't have a very good lawyer.

    I just read one member's experience of an HIV+ man accidentally shooting his load in his eye and he's fine and still HIV- years after.

    Ignorance triumphing over science. Just imagine how many more people would be HIV+ if saliva was an effective transmitter of the disease.

    I read that a few days ago and litterally screamed out out anger.

    I'm calmer now, but still annoyed that this happened when we've been educated that (and I'm trying to keep my fingers off of the caps lock since, this is like "preaching to the choir") there is no HIV in saliva.

    If I look at this in a more positive manner, I can see that it might be more of a blessing than a curse for the guy since he was homeless. At least he'll get some treatment and a place to stay. (Weak arguement for optimism, but that's all I got for a bright side.)

    How far have we really come as a society since 1981 when it comes to HIV/AIDS education? As a child I learned that a fundamental scientific way not to acquire HIV was through saliva, was Texas not on the same page? Grant it spitting is nasty but not deserving of a 35 year sentence. Everyday I look around and I see that our “American” way of life is slowly etching back into the dark ages, how sadicon_cry.gif

    Actually that wouldnt matter I know alot of states that have laws that claim its essentially attempted murder. There are inmates in CT serving longer sentences because they are HIV positive and spit on Correctional Officers. I also know of two cases, though probably more, in which the state is prosecuting husband because he knowingly infected his wife and didnt tell her he was HIV+ and and was receiving treatment for it.

    He is lucky. There are countries where flogging and death occur if you spit in public, china isnt one of them obviously.

    While I concede that categorising the saliva of a HIV positive man as a "deadly weapon" is reactionary, I think the circumstances of the case mitigate it. The fact that the man intentionally spat in the eyes and mouth of the police officer, and then told him that he was HIV positive suggests that he intended to infect him maliciously, or at least to imply that he was infecting him. This is a horrible thing to do. The sentence seems disproportionately severe for the act, but the plaintiff sounds like a really unpleasant guy anyway

    PHUCK YEAH THEY BETTER CONVICT HIM! How EFFING malicious does someone have to be to attempt to PURPOSELY infect another human being with HIV(basically, death if it was a disease)

    While I don't agree with the length of the sentence, I have to say that still is rude, and then to make it seem as though if the officer could get it from him spitting in his face, yea.. that's pretty f*cked up, yo. Even if it is a cop, ha.

    I am shocked and appalled by this article and have two things to say:

    1. The ability to call HIV infected spit a, "deadly weapon," is an errant observation and categorization. The fact that no one has ever been documented as having contracted HIV through saliva should be grounds for an appeal, hands down.

    2. It never is stated in the article that the motivation for the convicted individual to spit was an attempt to infect the officer with the HIV virus. If it was an attempt to infect the officer, then there existed malicious intent, however, the actual crime must be committed to be convicted. The fact that you cannot infect someone with HIV through saliva transfer deems that the crime he was convicted of was never committed.


    I think the convicted individual should be arrested and possibly sentenced for public intoxication, assault, and resisting arrest...any other charge is a byproduct of discrimination and fear.

    Whew, I was so pissed whenI first read this but I'm pretty calm now. Still, that was an abhorently horrendous act for that hobo to commit, considering he was trying to transmit the disease. What if, after knowledge that spitting is not an effective method, he slings blood instead? The impications are terrifying.
