    They got a guily plea inwhich a conviction was not going to be slam dunk apparently given the first mistrial.

    Me too. Both kids were under stress, and it sounds as if the school made some mistakes too. I wanted a stiff sentence, because we can't send the message, "Kill a gay kid if he hits on you and you don't like it," but this is a solid punishment. I'm also not upset about them dropping the hate crime angle.

    What a horribly sad story. I think the plea deal was fair, sad as it is that one young kid is dead, while another made a fatal mistake that he will spend the rest of his life paying for.

    This is probably the right outcome. Because of the emotion behind it, some might want a much harsher sentence, but a teenager found guilty of killing someone generally do not get a life sentence in the U.S.

    Not defending the murderer, but he got some really bad legal advice by taking the plea deal. He may well have won in a 2nd trial. Worst case is that he may have gotten life, but after 21 years in prison for murder, what life would he have anyway. Now, what will likely end up happening is that he will emerge from prison an even more dangerous man than he was already.

    Part of the defense to the hate crime charges was the victim's aggressive flirting towards McInerney and other boys and that probably played well with some jurors in the first trial that were not able to find him guilty. Without this being tried as a hate crime, the defense would have had to bring the sexual orientation aspect up first instead of the prosecution and that probably would have looked like blaming the victim. Other than that, the shooter didn't have much of a defense.
