    say you get married with your partner in CA, and reside back in NY, which recognizes gay marriage unions from other states...

    should things turn south, do me and my partner divvy up our assets based to CA laws (community property state) or under the laws in the state we reside in at time of split?

    I'm not a lawyer, but I went through a divorce in New York State. The suit is brought in the state that is the current residence of the one who initiates the action.
