    In Minnesota the age of consent is 16, but still you would think a 56 year old man would have enough enough sense to stay away from a kid on craigslist claiming to be 18.

    I didn't realize that.

    If that's actually the case, then this should be a non-issue.

    Sure what he did was taboo; but being gay is also taboo. I don't agree with a 56 year old being with a 17 year old; but if it's legal AND consensual, then the blame should be on the boy who lied...not the man who who got duped.

    Then again, I know nothing about the man. If he's one of the people who spout anti-gay rhetoric, then hang him for lying as well. If not, let him go and hang the boy for being a liar.

    More than likely, yes...even MORE likely, because it was another male.

    It's not uncommon for a 50+ year old man to date and/or marry a GIRL in her late teens or early twenties. It's looked down on by most of society, but it's quickly scraped from national news because it's perfectly legal...and because it's "straight."

    But let a 50+ year old man hookup with a 17 year old BOY where it's legal for a consensual blow job, and the nation goes nuts.

    It's gotta be Dems' disagreement with authorities that this is indeed a crime. In what state does a Rest Stop BJ not constitute a violation of some state law? Is it a "tree falling in the woods" thing, where it's only a crime if somebody sees it? I'm assuming this wasn't prostitution. And why was there an investigation in the first place: was the legislator under surveillance for something else? Did the young man contend it was a rape?

    Aside: Whatever happened with Phillip Hinkle (R-Indiana)? Was he ever charged after he was forced to resign? He definitely needed to step down for hypocrisy reasons, and so should this guy IF his legislative record/candidacy platform is anti-gay.

    Last year during a debate over a proposed gay-marriage ban, Gauthier asked his colleagues to “search your conscience and do what is right” and “to acknowledge the holiness of [a same-sex] relationship.”

    News TribuneMinnesota law requires certain information on calls for service to police to be made public — regardless of whether the call results in a criminal investigation — including the date and time of the call, agencies involved, the nature of the request of the activity being complained of, and witnesses to the incident, according to the Minnesota Government Data Practices Act.

    Both the Duluth Police Department and State Patrol said the agencies did not have “any public data responsive” to the News Tribune’s requests for information on Gauthier.

    After the News Tribune informed the agencies of what records should be public under state law, the information was released, though only details on the time, date and place of the call, and that it was a response to a report of “suspicious activity.”


    However, according to the Data Practices Act, the agencies should also release “a brief factual reconstruction of events associated with” a police response call.

    State Patrol spokesman Lt. Eric Roeske said the agency views that information as “criminal investigative data turned over to the Duluth Police Department.”

    The city of Duluth also refused to release the detail. Deputy City Attorney Alison Lutterman said it should be up to the State Patrol to release the reconstruction of the event as that agency created the data.

    Well placed sources today told the Northland's NewsCenter, the incident involved a 17 year old boy with whom Gauthier was reportedly engaged in a sexual act.

    Because the age of consent in Minnesota is 16 it is not illegal to have sex with someone who is 17. However it can be a misdemeanor to engage in sex acts in a public place.

    Our sources say Representative Gauthier met the young man on Craig's List and that police are investigating the potential that money changed hands which could make it a criminal matter.


    Looks to me like (a) the police couldn't prove a financial transaction occurred, and (b) absent the cash, there had to be exposed genitalia for the cops to distinguish an actual crime from just two consenting persons sucking face. On its face, a probably-routine rest stop police sting where the biggest punishment was a scare and a "run along now!" warning.

    KQDS Fox 21According to a narrative filed by a Minnesota state trooper, on Sunday, July 22 around 10:50 p.m. a woman told authorities she was eating in her car at the Thompson Hill Rest Area when a young man pulled down his pants and urinated next to her vehicle.

    During a search outside of the building the trooper found Gauthier who reportedly seemed startled by the appearance of authorities, according to released reports.

    The narrative notes that after troopers used a flashlight to get a look at Gauthier they noticed his fly was down and part of his shirt was hanging out.

    Gauthier responded to questions about his clothing by saying he didn't know why it was like that, according to the narrative.

    Troopers wrote they allowed Gauthier to leave and continued their search.

    Authorities then made contact with the 17-year-old who admitted to urinating in the parking lot and being the wooded area with Gauthier, according to the narrative.

    The 17-year-old told authorities that he and Gauthier had been "feeling each other" and that they had met over Craigslist. He expressed concerned that he would be "outted" and that it was Gauthier's idea to meet at the rest stop, according to the narrative.

    After the investigation had been turned over to police both the 17-year-old and Gauthier admitted to performing oral sex on one another. According to reports, no money exchanged hands.

    Gauthier is currently campaigning to continue representing Minnesota House District 7B. His will take on Republican opponent Travis Silvers this November.

    Gauthier, who is unmarried and is gay, said in an earlier news release in which he vowed to stay in the race that he is a “chemically dependent person and has been in recovery for over 30 years with one relapse,” reported ABC affiliate KSTP.

    The first-term legislator didn’t detail his “chemical” dependency nor indicate that he would leave office before January. He was hospitalized last week as the scandal broke, and told the AP that he overdosed on muscle relaxants in a suicide attempt.

    “I also need to recommit myself to my sobriety program,” he said in his earlier statement.

    He doesn’t plant to attend a Friday special session of the House of Representatives to vote on flood-relief aid for his district, which was affected in June by flash flooding.

    “I just think it would be a distraction,” Gauthier told the AP.

    It's hard to be disappointed at anybody other than State Rep. Gauthier (DFL/#YCYL - Duluth) for potentially causing a Dem seat in a statehouse to get flipped because he couldn't bring a Craigslist date to his own crib. And as far as hookups go, how unimaginative and passe is the wooded area of a highway rest stop, really? I suppose the MSP Airport bathroom stalls were full this time?

    Had Gauthier insisted on soldiering on, his issues would only serve Repubs in distracting lower-info voters in a state where a same-sex-marriage-ban constitutional amendment will be on the statewide ballot this fall. "Gay Pol Insists on You Validating the 'Holiness' of Gay Relationships, Then Blows a Teenager at a Rest Stop. VOTE YES!"

    The local media in the TMZ age was going to pursue this story no matter how trivial it was on its face.

    The State Dems likely knew he had enough issues going on (sobriety, at minimum) that this incident, legal only insofar that he wasn't caught with his draws down, would be a tipping point, and is trying to cut its losses. Maybe with a replacement candidate in time for the general election.

    The 17-year-old... well, he's just a horny 17-year-old, never mind him.

    After giving it a second thought, you are correct. No laws were broken and so we should probably not put our personal beliefs of what is age appropriate for other people. I still do think it may have been some poor decisions on his point, as politicians have lost their jobs in scandals where no laws were broken.

    I may be turning a rock that doesn't need turning, but is there a good reason NOT to have a Federal "age of consent" definition (maybe there is such a thing, I dunno?)

    Between "defining marriage" and "defining the age one can consent to any sexual acts," at first glance, I'd think the latter would have far more national importance.

    I'm not arguing over 16, 17, or 18, just wondering aloud whether it makes sense to let "states' rights" be the arbiter of what consent is.
