    Will be interesting to see the results of this case. The spirit of the law, from my understanding is to prevent random testing without the patient's consent in an effort to protect privacy and prevent witch hunts. In this case, the patient went to the doctor repeatedly for complications and showed symptoms. As a doctor, is he supposed to spend money testing her for everything other than the diseases he suspects? It's like going to an auto repair shop over and over because your car won't start and asking them to check everything but the battery and alternator.

    The other key question is whether or not she signed insurance or any other documents that give consent.

    This was not done well in the sense that Jane Doe did not receive counseling and the results were not kept confidential, and the doctor broke the law.

    This is a classic case that someone's good intention came out wrong.
