Car accident woes

    Gay gods of Realjock, I require your advice.


    On the 5th of January, I was in a car accident. ***EDIT***

    At the end of the ordeal, I end up with a citation for failing to maintain a safe assured stop distance. The professional driver is not cited for anything.


    TLDR:
    Dude does an illegal U turn and I hydroplane into the side of him because he takes up all lanes of traffic.


    My question: Who is at fault?

    Any advise on the situation would be sooo helpful. Aside from issues with getting all parties to make sure they are doing their due diligence, I can't help but feel I am being wrongs for being found at fault. Am I right?

    EDIT: Thank you guys for all of the info. This was my first accident and, at the time, I was naive to think I knew all that I could to defend myself.

    If the courts really use the redacted info against, I have something bigger to be worried about because they should have that information already.

    Even if the other driver is doing something illegal or stupid you still have an expectation to avoid the accident. The fact you hydroplaned into the truck will work against you in suggesting you may not have reacted fast enough or were travelling too fast for conditions.

    Yep it's true. Even though we're surrounded by asshole drivers doing insane things with their cars, if there's an accident they can blame us for the accident because we are supposed to be "in control" of our vehicles, which means being able to stop in time to avoid the other assholes around us.

    In Asia and Europe and especially Russia, everyone has a dash-cam. It records the view from your windshield to document the minutes before any incident you might need to explain to the police. They haven't caught on yet in the Americas, but I'm sure as hell getting one.

    Go on YouTube and search "dash cams." Hours of endless bad driving fun caught on cam!

    My dad was a cop, and once you've hydroplaned or any situation that causes you to lose control of your vehicle, you are at fault. That's the way the insurance companies see it. Hope you were ok, and that there wasn't too much damage done to pay out... Always think it could have been worse.
