    Montana House Republicans stopped this in committee in 2011, I expect they'll do the same again. Reversing the State Supreme Court ruling decriminalizing gay sex is in the GOP State Party platform, so I think the repeat failure of this latest version of the bill to formalize the Court ruling in State law is a foregone conclusion. The Montana GOP campaigned on making gay sex a crime once again, so GOP-led House members really can't allow this bill to pass.

    Of course it's unenforceable, but they like to keep these statutes around just to make some ideological point. Best example: Mississippi only outlawed slavery last month - 148 years after the federal ban.

    it does. That court ruling made all the existing state "sodomy laws" unenforceable. But the laws are still in the states legislation, even though they can't be enforced. So what Montana is trying to do, decriminalization of gay sex, is effectively a symbolic gesture of good faith to the LGBT community. But socially conservative Republicraps will probably shit all over this and try to stop the legislation change.

    Good example. Plus in the case of the Montana GOP party platform, they're still pressing for the State Supreme Court ruling decriminalizing gay sex to be reversed.

    If it is reversed, the law making gay sex criminal needs to still be on the books. So that gays having sex can be arrested and sent to jail. This is what Montana Republicans want, according to their official Party platform. And RJers here say we should vote for these Republicans???

    Not all Republicans are Montana Republicans. Just like not all Democrats years and years ago were southern Democrats who wanted to maintain slavery. Just to play devils advocate for a moment.

    Who wants to bet many Republicans will still vote against repealing it. The article shows there is still a lot of conservative opposition to even repealing this outdated law.

    "But opponents argued the measure goes against Montana’s values, and say the Montana Supreme Court disregarded those values in its ruling in the 1997 case Gryczen v. Montana.

    Montana Family Foundation President Jeff Laszloffy said the measure is not a simple “cleanup bill” but a vital component to one of the greatest moral debates of the last 20 years.

    Lawmakers should allow the debate to be “settled outside the walls of the Capitol,” he said.

    “We haven’t come to grips with who we want to be as a people,” he said.

    Other opponents echoed Laszloffy’s concerns. Dallas Erickson of the group Montana Citizens for Decency Through Law said he “dreads that we are slouching toward Gomorrah.”

    Montana Family Foundation is a lobby group that endorses Republicans and supports them, and most Republicans in Montana they rated were given a "100%" rating.

    A good friend of mine was the Dean of the School of Arts and Architecture in Bozeman, in the Montana State University system. A guy I'd known since 1975, the first gay friend I ever had. He was forced to resign because he was gay. So yeah, tell me about Montana gay prejudice.

    (Fortunately my friend went on to much better things, a famous published author of great academic credentials & standing. So FU Montana, for kicking out a distinguished scholar you rednecks didn't appreciate or deserve in the first place)

    It would be awesome if Montana not only approved this symbolic legislation repealing the archiac sodomy laws but also shock the nation in approving gay marriage.

    I want to see the beautiful, frontier state of Montana legislate gay marriage as the law of the land. Just think of how many tight jean clad, pickup truck driving, masculine cowboys would become available for the pickings. I would also love to see Wyoming and Nebraska legalize gay marriage as well. That would be very sweet.
