    I've searched on Google and haven't found a really good answer. So far, things seem to point to me being legally sound in this, but I still would like to ask the gay community because they might have experience on such things since online dating profiles are part of our lives.

    I have a blog where I, and several dozen others across the globe compliment, ridicule, and parody photos on Grindr. I've received a number of requests to take profiles down. But I haven't caved. I feel my work is bound by fair use.

    One guy is upset over it. He is a deaf guy and had a profile up asking if anyone had a hearing fetish LOL I could not help myself. I had to share it with world and add my own commentary.

    Is taking a photo of a profile and using it for commentary breaking copyright? Or am I right in my current analysis? (Setting my morality to the side on this by the way, this blog is way too fun.)

    I know that it's fun to laugh and joke at some of these ridiculous Grindr profiles, but I can't stand blogs like yours. If their Grindr profile was meant to be "seen by the world", then they would've made that happen themselves.

    I think you should respect their privacy (yes, I know Grindr isn't always a "private" thing).

    And if someone asks you to take down their pic THEN YOU SHOULD. What the hell makes you so high and mighty? "But I haven't caved. I feel my work is bound by fair use." icon_rolleyes.gif

    A. If the photo is public, in LEGAL terms it may not come under copyright!
    if it is a private, that's a whole different story
    It says more about you than him,
    in MORAL view it is absolutely wrong to make fun of others(including your enemies)

    A. People usually are wrong when they analyze something putting their morals aside!

    it could also be viewed as slander since the person your talking about doesn't have a public profile or hold/maintain a public persona.

    America has freedom of speech and all but it doesn't extend to private people. it could be considered detrimental physically/mentally.

    Although that's just my take on it.

    On a personal note, I think guys like you have such sad lives. you have to degrade others for entertainment.

    I'm sorry, but only a self-righteous arrogant person would deny someone's privacy by not taking down a photo of theirs; then allow other people to publicly ridicule these for their entertainment. Are you that bored?

    Now if you wish to attack my morailty, I see no way you can go wrong in that. However, the definition of self-rightousness and arrogance do not apply in this scenario. I am asking the legalities of it. Commenting is not allowed on the blog. The blog brings in a nice supplemental income, so it does serve a practical purpose.

    I am perfectly fine with you doing whatever you wish with my photos. As a matter of fact, there is already a website that does that. I am not phased. What you or anyone else posts about me on the internet is negated in the real world. As a matter of fact, the power of social media is only created when enough people give it that power. As I am no one famous, the chances of anything said about me on the internet gaining the power over my life is slim.

    It depends if the person's profile is set to publicly visible or only visible by people who have joined the site, and also RJ has rules about not being allowed to post pics that have been defaced so you would be banned if you did the other ideas.

    That argument is invalid, music is played publicly but isn't public domain. Books are distributed to the public but aren't public domain. art is displayed publicly but isn't public domain.

    With all these things you can critic these items but only to a certain extent.

    Now if the photo was taken in a public setting with a model release you can have at it.

    Alas go read to rules of grindr photos. You'll find that the owner of the photo still has control over his photo in most situations that are outside of grindr desires aka "marketing purposes" for which your website is not endorsed, supported or owned by grindr or grindr's parent companie/s.

    actually it doesn't matter if it's publicly viewable or not.

    When you join this site you agree to the terms of service. Those terms allow realjock to display your photo/s on this site and potential others as described in the terms of services.

    However it doesn't allow anyone else to use those photos and ultimately you maintain control over the use of these photos outside of realjock and realjock does not have whole ownership of any/all photos uploaded to this website but only ownership in how it can use these photos for it's own business interests.

    I've actually put a great deal of thought into the situation and even solicited the opinions of many others, so I do not know where you are coming from. My message of not caring about the use of my photos is very factual. The ones I do care about I keep private. But I have a feeling your response was grounded more in emotion than logic.

    That being said, I have decided to keep my blog going unless I am practically stopped. No one has given a rationale as otherwise, and this topic seems to be already spiraling into something it shouldn't be.

    I only use my powers for good. I really dont have time to waste on you, but just as a courtesy, if you used someones photo, without a contract ( you are basically screwed legally) especially a deaf guy, someone who is a nice guy would take it down.

    If someone asks you to take their pic down you do it. Simple. You never know when the next one comes on legal letterhead. It doesnt matter if you are "right" or "wrong" I'm guessing you havent incorporated the site and legal fees win or lose are going to put you in a world of hurt.

    besides the fact you sound like a douche bag, you don't have the right to publish another person's photograph. technically, it's not as if his pic is copyrighted; however, there is no dispute over the ownership of the photo. it is legally his, and you are reproducing it without his permission. oh, did i mention you're a total douche bag?

    You're very cruel. Deaf people have a lot to put up with from the hearing community, this being one of them. (yes this guy is inquiring about people who would rather integrate, but there are a lot of challenges on both sides in relationships between the hearing and deaf)
