This is the first time in over 100 years that North Carolina has had a republican governor AND a republican controlled legislature at the same time. So the chances are good that it would pass the state test. Probably not so much the constitutionality test on the federal level.
And it did sort of pass before. Until a supreme court ruling banned it, you could be disqualified from public office for not believing in God. Still on the books, though not valid.
