    Wow... That's really messed up.

    Have you heard any of the managers make derogatory remarks about Jay?

    If he can't do the newly imposed shift and ends up getting fired, it seems like he may have a case for constructive dismissal and discrimination in the workplace.

    I'd advise you to advise him to seek legal advice.

    Unfortunately, 28 States have no protection against employment discrimination on the basis of Sexual Orientation. No State in the South has laws protecting gays against being fired for being gay.

    Really not sure there is anything you can do.

    You're in Red State Alabama, where Republicans have made sure there are no work protections of any kind for gays. Sad but true, this guy needs to move to a State where gays have some employment rights. And watch your own back, now that you came out in support of this guy. You don't have any rights, either.

    Josh, if you pursue this, "they" can make life harder for you at work as well. So, have a back-up plan.

    However, you do have a valid point. I'm not sure what the labor laws are in your state. However, I'm pretty sure it's either illegal or at least unethical to hire a person to work for a specific shift, and then switch them to a different shift after being hired.

    So this isn't specifically a gay issue. I don't think this will jive well for any new hire.

    Since your store manager is blowing you off, your next course of action is to notify corporate.

    But you really should ask the new guy how he feels. Does he really want the job bad enough for you to put your neck on the line?
