    Evil Right Wingers just won't admit defeat, still trying to resuscitate Prop 8 in California, and stop same-sex marriages there, even after the US Supreme Court decision. They just suffered another defeat today (Sunday) when Justice Kennedy denied their motion. Good! icon_biggrin.gif

    Anything else would have been a big, unpleasant surprise and pretty much meant that the votes for reconsideration had been there.

    When you lose a SCOTUS case, you have 25 days to ask for reconsideration, which is never granted (unless, perhaps, one of the justices dies, or some major new developments arise). The stay by the 9th Circuit was imposed, and then lifted, by a trade off based on the probability of a certain outcome of the case, and the balance between the damage that could have been done by potentially having to annul marriages. Now with the outcome 99.9% certain (the only possibility of a loss in this case a granted petition for rehearing), the balance has clearly tilted in favor of resuming marriages right away, and the 9th Circuit acted accordingly!
