    The first two are pretty much standard fare for the anti-gay crowd but does France make it a crime to speak ill of a gay person in public?

    In the Déclaration des droits de l'homme et du citoyen (Declaration of the Rights of Man and of the Citizen), Article 11 states:

    "The free communication of thoughts and of opinions is one of the most precious rights of man: any citizen thus may speak, write, print freely, save [if it is necessary] to respond to the abuse of this liberty, in the cases determined by the law."

    Currently, French law protects six 'identities' from negative or depreciatory speech: racial groups, religious groups, ethnic groups, gender, physical disabilities, and LGBT persons.

    This all gets a little messy due to the difficulty in definiing what constitutes an affront or defamation. Case in point with the current anti-Islamism which prevents women from wearing a burqa or head-scarf as part of their religious expression.

    According to French law, this is acceptible to prohibit because it does not meet the consensus definition of contempt. Similarly, I would imagine, expressions that run counter to acceptance of the civil rights of marriage may be deemed hateful even if they are only founded in ideology. This is also the same reason why wearing any symbol of faith is prohibited of persons in an official status, such as a teacher wearing a crucifix.

    Don't get me wrong, there's a lot I'm thinking France does right. But their legal system is a beast that makes the US Constitution look pretty tame in spite of all the crazy that's been appended to it over the years.
