I know the kid had to get hard AND climax but 34 to 15 is child abuse pretty much everywhere in this world where common sense exists. This woman cannot possibly demand child support out of this. Like WTF

The state doesn't want to foot the bill and would rather pass the buck to the victim. Seeing as she committed a crime, she should not even have custody of the child, she should a registered sex offender with no custodial rights.

Sadly, Nebraska law seems to favor the mother no matter what. I know my niece's mother was busted time and again for drug/alcohol abuse and even though my brother fought it, his daughter was still returned to her mother.
The state even tried to collect child support from him while he had custody because the mother was in jail.icon_eek.gif
It will take some unfortunate tragedy to spark reason or just plain common sense in our judicial system.icon_sad.gif

bangingwithmrcooper saidthe justice system doesn't protect male rape victims.

As tragic as this story is, sadly it does not surprise me. Not until recently did the FBI's definition of rape even include male victims or female perpetrators.

    http://www.fbi.gov/about-us/cjis/ucr/additional-ucr-publications/ucr_handbook.pdf/view
"carnal knowledge of a female forcibly and against her will." was the official definition since circa 1920.

I feel for that guy. With a shitty economy, finding a job to support just himself will be hard enough to do, let alone one that pays enough to cover child support payments. It doesn't help that men can be jailed for failing to make child support payments - one of the few forms of debtors' prison left in the US. (I believe they're jailed on contempt of court.) It's amazing how a woman has the rightful choice to abandon motherhood at will (ie. have an abortion), yet a man does not have that same right (ie. he's forced to pay child support). icon_idea.gif

Male rape victims, like female rape victims are known to climax even if they don't want to but for this to go on for years, the 15 year old must have been willing but clueless.
Still disturbing. Where are this kid's parents and where is he supposed to get all that money?

I'm not sure if I would call this "rape". Yes, he was underage, but who wouldn't try to bang his babysitter if he could?

"Wanting" and "consenting" are two different things. The former is expressing a desire, the latter is giving permission. Rape is usually defined in terms of consent (ie. non-consensual sex). Legally, minors and incapacitated people are unable to give consent. So an adult having sex with a minor is considered (statutory) rape because the minor cannot legally consent to have sex.

This is one of the proofs that, true justice will not come from any organizations...
The law systems are good only to a certain level...it's imperfect...it can only be perfected by man, but unfortunately many men believe that we should live according to the laws and very few look for loopholes and of those few, fewer tries to change them. of those few attempts very minute succeed.

as a great man once said
"Good people do not need laws to tell them to act responsibly, while bad people will find a way around the laws." -Plato

It means that laws are imperfect and can never be perfect, where as a wise man can give the right judgement...

Obviously, in this case, the judge or whoever gave the final judgement is not wise!

Too bad for the kid. His life is now ruined. Too bad for the unwanted baby. Mother should have gotten an abortion. Why don't the pro-life religious nuts groups pay for kids like this? Oh, I forgot - they only believe in the right to life from conception until birth - then no rights at all.

No, there are lots of countries that are not sex-phobic, where the age of consent is 15; or even 14.

So, unless you are a female school teacher, nothing happens to you. I say let the 30-something broad pay for her own bastard. Same with the two lesbians that paid $50 for a sperm donor.

Woman can have equal rights, but they get sort of pissy about sharing the burden of their own bad judgement.
Can't have it both ways, sister.

Since she is a rapist and pedophile child molester, wouldn't he have the right of full custody?

    Here's a similar one from 1996

Statutory Rape Victim Ordered To Pay Child Support

December 22, 1996|By Erin McCormick, San Francisco Examiner.

SAN FRANCISCO — He was a 15-year-old kid with all the usual teenage sexual passions.

She was his neighbor--a 34-year-old mom, later convicted of statutory rape for engaging him in a romantic tryst that resulted in her getting pregnant.

"This is a really bizarre case," said Mary Ann Mason, a social-welfare professor at the University of California at Berkeley who specializes in societal legal issues. "It seems unfair that he was taken advantage of, and then he gets prosecuted for child support. He's considered a victim on one hand and a perpetrator on the other."

Attorneys from the state attorney general's office, which represented the state in the appeal, say the teenager should be responsible for the child because he indicated he was a willing sexual partner.

"Our point of view is that the newborn is the victim in these matters," said Carol Ann White, a lawyer who heads the attorney general's child-support-enforcement unit. "No matter what the circumstances of their conception, babies deserve to have two parents.

"And this was a consensual relationship," she added.

Yet another reason why it's good to be gay.

I find somewhat compelling this idea of the infant as the ultimate victim even while it seems the "father" might get victimized twice. It's a horrible situation.

In the case of an underaged kid who maybe admits that the relationship was consensual even though the older woman winds up with a rape charge and jailed and even though the law says he wasn't old enough to consent, that seems to be an extenuating circumstance, particularly within a legal system where in certain cases of murder a child might be tried as an adult.

In this case, if the rape wasn't simply technically rape but actually forced, then maybe the judge could have gone after the parents who forced this kid by their authority to be alone with a rapist.

And then to make whole the infant, innocent beyond a shadow of a doubt, judgment for child support should have befallen the parents of the rape victim.

In this case ultimately the infant should be made whole with proper support and ultimately it was the parents who put their kid at risk when he was old enough to not even require supervision.
