how do you know they were recording you and they weren't playing with their phone? did you actually see the footage?

Well they have to aim the phone at him to record him and if they're recording they're not going to be fiddling with it.

You should have called them out on it right there and then. You can make them delete it and let the staff know too

Well I'm not really sure but the way he was set up, on the leg press machine but standing in my direction, phone turned sideways with both hands on the phone ..so he was either recording or watching a movie, now this guy has never talked to me prior to this day when he complimented my leg circuit..and him being a lot buffer than I am but with chicken legs kinda makes me think he was recording it

No cause I was on the squat rack and the only thing behind me is a mirror I trmoved to go do rows which would put me behind where he was but he just moved to another machine that was once again behind me

Could've been worse - at least you weren't on the adductor machine. On the bright side, maybe you're doing something right!

I'm not positive about this but as I remember, legally you can take pictures of someone, without their permission, if you aren't going to publish it or use it commercially (make money from it). Of course, good manners would dictate otherwise.

Unless you have absolute proof that he was recording you, there's nothing you can do.

    Talk to management anyway.
A "NO RECORDING HOT GUYS" sign couldn't hurt.
Many gyms already have NO PICTURES signs.

Not that this is the case for you, but there are people who go around and record other people working out in bad forms and post the video clips on facebook group called awkwardgymmoments for good laughs.

I'm sure that's not the case for you.

He may have been recording your routine to use it later. I still would have called him out on it, at the very least he'd know you know.

As far as fooling around on a phone and taking a video it's very easy to tell the difference between the two.

Kinda sorta. That would be mostly true if you were out walking around in public. But the gym is a private business and you have "some" level expectation of privacy. Also, a lot of gyms these days have a no photography rule these days.
