    TNCRMAfter the ruling, Texas Attorney General Greg Abbott, running to become the next governor, demanded the state be allowed to defend its law in court. He’ll be appealing the ruling.

    There is no indication that same-sex couples in Texas can now marry.


    Still, I like how it's the already-married (somewhere else) couples showing how the bans are Equal Protection violations. In this case, it's a person seeking child custody rights that were blocked, somehow, because of her unrecognized out-of-state marriage.

    Also noteworthy, this here is a STATE district court ruling.

    San Antonio Express-NewsSAN ANTONIO — In a move that follows suit with a federal ruling issued in February, a state district judge has deemed Texas' restrictions on same-sex marriage unconstitutional — paving the way for a San Antonio couple's divorce proceedings and subsequent child custody battle to continue.

    Judge Barbara Nellermoe, in a ruling released Tuesday, pinpointed three portions of the Texas Family Code as unconstitutional, as well as Section 32 of the Texas Constitution.


    The Federal district court ruling that TX's Section 32 is unconstitutional from February is pending appeal as well. Greg Abbott is gonna be one busy man. icon_razz.gif

    San Antonio Express-NewsThe latest ruling comes in response to a same-sex divorce lawsuit that was filed in Bexar County in February by Allison Leona Flood Lesh and Kristi Lyn Lesh, who were married in Washington, D.C., in August 2010.

    Kristi Lesh became pregnant through artificial insemination during the marriage and gave birth Feb. 19, 2013. Her attorney argued that because Allison Flood Lesh isn't the biological or adoptive parent, Kristi Lesh should retain sole custody. Allison Flood Lesh is seeking to split custody of the child.

    Because Texas doesn't recognize same-sex marriages, there's also no legal avenue available to pursue a divorce.

    It was already done federally in Feb and so this isn't really a big story or surprise, it is VERY hard to find any stories on it besides these small, small sites

    The Texas ban against marriage equality has been struck down by by federal and state courts. There is a federal stay on the actions, pending appeal by Dumbo Perry / The Texas AG.

    If you were married outside of Texas, your federal 14'th Amendment right of equal protection under the law will apply to Texas, as well.

    However....Rick Perry has basically instructed state agencies in Texas to give same sex couples the run around, including same sex couples from the armed forces, and other federal agencies, refusing to service them at state offices, and instead making them utilize a federal office for their service requests. Perry has actively obstructed same sex couples wherever he has been able to.

    Texas is almost always last to get on the right side of history, for just about everything. Sad, but,...true.

    The codified bigotry now has been struck down at both state and federal levels, and it won't survive, but, Perry and company will waste a bunch of money trying to win votes from The Crazy Religious Right (wrong).

    Sadly, most Texans support marriage equality. This is why you MUST vote The horrible GOP out. It DOES matter.
