    It's no secret that we're not fans of President Obama, but we have to thank him for his work toward equality in this context. The problem with an Executive Order which exceeds Federal purview is that in 1952 the US Supreme Court clarfied in Youngstown Sheet & Tube Co. v. Sawyer that Executive Orders must not attempt to make law but rather to clarify or act to further a law put forth by the Congress or the Constitution. This opens a huge hole for activists opposing the cause because they can argue that this EO expands the intent of FMLA, doesn't clarify it. It'll ultimately lose, but it's bound to be a long battle.

    And that’s why I’ve directed my staff to prepare for my signature, an executive order prohibiting discrimination by federal contractors on the basis of sexual orientation and gender identity. (Applause.) Because in the United States of America, who you are and who you love shouldn’t be a fireable offense. It would be better, by the way, if Congress passed a more comprehensive law that didn’t just cover federal contractors. And we need to keep working on that, so don’t take the pressure off Congress.

    This seems to be a pattern these days. Everybody has just given up so much on Congress that we end up doing something through executive order. And that’s helpful, but it doesn’t reach everybody that needs to be reached. Congress needs to start working again, so let’s make sure that we keep the pressure up there

    Hmmm... let's see if any Log Cabin Republicans get the nod. Hopefully, WH security won't be wearing rubber gloves, like they were the last time a bunch of gay glitterati were invited there by a Democratic President.

    Add me to the list of gay GOPers who loathes Obama but nevertheless appreciates what he is doing for gay rights - as long as he acts within the law, of course.
