Protecting RJ from copyright enforcement (New York Times policy)

    Several of us, myself included, have in the past occasionally posted links from a variety of sources and sometimes included excerpts. Given that one member has been posting a very large number of articles with a very high frequency from the New York Times, I wanted to point out to any involved, especially the Admin, that there are potential copyright issues. Given the quantity, the Times could assert such copying exceeds any reasonable fair use standard. Unless the member involved can show the Admin, either publicly or privately, that he has specific permission, the Admin might consider the New York Times policy:

    No. I am offering the opinion that your use goes far beyond fair use. Not only given the volume of what you post, but the complete lack of any commentary or criticism, for example. If your posts were primarily your own words with small excerpts from the Times, it would be a different issue.

    Your asserting fair use indicates you have no association with the Times nor any specific permission to be copying their articles and posting them elsewhere.

    The question is if the Admin chooses to accept your interpretation, and be willing to defend should the Times decide to enforce their policy. My guess is no, especially reading their policy in the OP. The Admin might also note that many sites do not allow simple posting of articles but insist on discussion. That's what Forums are generally used for, and not a collection of links to other sites.

    Your thread title is "Protecting RJ from copyright enforcement." So you have performed a copyright infringement analysis to render that legal conclusion? Also when you made the legal conclusion that my use "goes far beyond fair use", how do you do that if you do not perform a legal analysis?

    Am waiting for your answer.

    What you might want to do SoCal is send a few of these threads over to the NYT and see what they think.

    I wasn't aware of any of this because I've had Giggles on forum block since his 'Giggles' day.

    I removed all my blocks a couple of weeks ago and certainly see why I had this particular one blocked.
