On Facebook the Dallas Voice admits they did no fact checking on the story submitted by a free lance writer.
According to the Dallas Voice post, the Tulsa PD "continue to refuse to investigate this suspicious death, despite the families repeated pleas that they do so,". The Dallas Voice post also claimed that no autopsy was performed and the "body was immediately cremated at the request of the police, due to his HIV status." The author of the piece never spoke to anyone at the Tulsa PD, including Sgt. Walker who is mentioned in the post.
Toby Jenkins with Oklahomans for Equality said they conducted their own investigation and found that the man died of natural causes.
Jenkins said: “We’re so disappointed that a media source that identifies itself with the LGBT community didn’t do more research and investigation and even reach out to us in Tulsa,”. Jenson also told Fox 23 Longoria's own doctor told him she was misquoted by the Dallas Voice post. She believes the man died of natural causes and signed the death certificate.
The Tulsa PD released a statement that reads in part:
"Mr. Longoria’s death was not suspicious in nature therefore it was not further investigated. The Tulsa Police Department does not investigate deaths in which there are no signs of foul play and the individual’s attending physician will sign the death certificate. The Tulsa Police Department responds to many natural deaths in which the attending physician signs the death certificate and there is no autopsy conducted.
Sgt. Walker and other members of the Department have spoken with the family members of Mr. Longoria several times to provide information reference area funeral homes, the medical examiner’s phone number as well as providing them with the victim’s obituary."
The Oklahoma State ME's Office says that Mr. Longoria died of complications of chronic ethanol abuse and foul play played no part in his death. The ME's office also pointed out that law enforcement agencies have no authority to order the cremation of a body, saying that the body was released for cremation by the ME's Office per the family's request through arrangements made with the funeral home.
