Federal Judge Upholds Gay Marriage Bans, Sets Up Supreme Court

    "The likelihood that the U.S. Supreme Court will decide the issue of same-sex marriage grew stronger Thursday, when a federal appeals court upheld bans on marriage for gay couples in four states.

    By a 2-1 vote, a panel of the 6th U.S. Circuit Court of Appeals, based in Cincinnati, rejected challenges to the bans in Ohio, Kentucky, Michigan, and Tennessee. The ruling reversed lower court decisions, currently on hold, that declared the state bans unconstitutional."

    "In just eleven years, nineteen States and a conspicuous District, accounting for nearly forty-five percent of the population, have exercised their sovereign powers to expand a definition of marriage that until recently was universally followed going back to the earliest days of human history,” [Judge] Sutton wrote [in the majority opinion. He said such a decision should be made by the people, not the Courts.

    But Judge Daughtrey slammed the majority opinion, which she said would make an “engrossing TED talk” but that “wholly fails to grapple with the relevant constitutional question in this appeal: whether a state’s constitutional prohibition of same-sex marriage violates equal protection under the Fourteenth Amendment.”

    Does not surprise me, these 4 states, home of tea party's most notorious radical wackos, feeling more powerful since the right wing take over of the Senate, Ruth Bader Ginsburg predicted the outcome as such. icon_rolleyes.gif

    Let me guess, SCOTUS not until next year, around March begin April?

    Let me guess, SCOTUS not until next year, around March begin April?

    The Court could conceivably take up the issue this session, but it would be exceptional, since the calendar is already set.

    recent mid term changes in the congress would make a liberal appointed SCOTUS judge difficult for the next two years.

    If any judges were to retire in the next two years.

    I am thinking this is tied to that in a way.

    just maybe all the lgbt gains gone down the tubes.

    Not merely difficult, but impossible to seat any judge on the Supreme Court who isn't a conservative. And no qualified non-conservative nominees will want to endure the abuse of hostile Senate hearings and sure rejection.

    Unfortunately the most likely Justices to retire or die first are the liberals. The most frail conservative may be the incompetent Clarence Thomas. The unethical fanatical gay-hater Antonin Scalia wiil be around even longer.
