    "So the question presented by Walker is whether a proposed specialty plate, designed by a non-government entity but issued by the state of Texas, qualifies as government speech or private speech.

    Breyer, and the four other justices in the majority, conclude that it is government speech.

    In doing so, he lists several factors that point in this direction, including the fact that “the history of license plates shows that, insofar as license plates have conveyed more than state names and vehicle identification numbers, they long have communicated messages from the States.”

    Justice Thomas agreed with the court's liberals that the state of Texas was not required to issue a Confederate Flag license plate.

    No group, including the Sons of the Confederacy; Drag Queens Under Sheets or other costume-based organization can compel a state government to issue their pet license plate.

    Hardly "unexpected" to anyone actually familiar w/ Justice Thomas's real jurisprudence, not just the left's mistaken and reduced comprehension of it.
