Marion County judge refuses to perform same-sex marriages

" A Marion County judge has refused to perform same-sex marriages and has asked his clerks to refer couples seeking same-sex marriages to other county judges.

Judge Vance Day, a circuit court judge and former chairman of the Oregon Republican Party, is now facing an ethics investigation over that decision, according to the judge’s spokesman."

Marion judge says he won't perform same-sex marriages

"Patrick Korten, a spokesman for Day who is based in Virginia, said the judge has never performed a same-sex marriage since joining the bench in 2011. He stopped performing marriages of any kind this spring and informed his staff that when same-sex marriage became legal in Oregon to refer couples seeking all marriages to other county judges.

Korten said Day stopped performing marriages prior to the United States Supreme Court's ruling on same-sex marriage in June.

The investigation came to light Thursday after the Oregon Government Ethics Commission gave Day permission to create a legal fund for himself. According to Korten, Day told the commission that he needed the fund to help cover legal expenses he expects to incur defending himself during the judicial ethics investigation."

    ...

"He has a right to those beliefs under the United States Constitution," Korten said.

In Marion County, judges are not required to perform marriages. Marion County's website lists five active judges and one retired judge who are available for ceremonies. Day is not on that list."

I have no problem with this one. Just like no doctor should be forced to perform an abortion, no judge should be forced to marry someone no matter the reason. A judge marrying someone is not the same as the clerk case in Kentucky. She is the ONLY official in that county who can issue a license to get married. You can find another judge to perform a ceremony.

Oh, and by the way, the cunt clerk is a DEMOCRAT.

That comment says more about the poster than the judge. Bad stereotype of a catty old queen.

I think there's a HUGE difference between doctors who refuse to do abortion and judges/clerk who refused to perform same sex marriage.
Anyone feel free to correct, but isn't the job of clerk and judges are to do their duty and uphold the law of the land, not the bible. They basically should approve if the criteria to get married for the couple are met, according to the law. They're not the one who get gay married, the couples are.

But abortion is different, because they actually perform the killing/abortion or whatever you wish to call it. The blood would actually literally be in their hand. They'd be stopping a baby's heart and throw them out (is this true? with all that scandal with planned parenthood?).
And the doctor's oath is different than the judges' and clerks' oath. Unless the abortion is necessary to save the life of the mother.
There's a good reason why in UK doctors and nurses are free to refuse to do abortion.

Yup, that's me. While I'm pro-life, I won't stop any woman to get abortion, because that's none of my business. And that's their right.
I just would not be part of it, but then again I'm not a doctor.
I have an opinion about it because years ago, I was considering to be a doctor but let's say life took me in different path.
I would, however, take good care of the patient, AFTER the abortion, if that's required, because as a doctor you do have to take care anyone who need it to get their health back. I'm carefully trying to draw the line there.
but the killing the baby? I would rather be killed myself than doing that.
I think that's the line there, I wouldn't take away their right.

But yeah, at first I kinda do see the similirity with Kim Davis situation. But then when I heard she could just let her deputy issue marriage license, but she still refused to do that, and then her husband screaming about "welcome to Sodom and Gomorrah" then that's it I lost my sympathy right there. Because it looks like they do try to make a statement and actually trying to take away other people's right

Throw this arsehole in jail too. That's where he's going to wind up, and rightly so.

I love how all of the repuke douchebag trolls on this site keep pointing out that the cunt in KY is a Democrat. So? There are Democrat bigots too. But like the MAJORITY of repukes she is hiding behind her phony/ignorant religion as the shield for her bigotry.

And she may be a Democrat, but all I hear are the repuke candidates defending this stupid homophobic cunt in public.

I'm sure that the repuke douchebag ilk on this site feels the same way. icon_rolleyes.gif

That's sort of like saying this public school does not accept black students. But that's not really an inconvenience because we have other county schools where black students can go.

This appears to be some sort of publicity stunt. He formed a defense fund, then held a press conference to start the whole thing. Probably he's planning to run for some other office on a right-wing platform.
No judge or other official is required for a wedding. All you need to do is file the signed form with the county clerk. Bam! You're done.

People being paid by taxpayer money should have to obey the law.
Maybe he can share a jail cell with the Kentucky redneck woman?

Oregon Judge Who Refused to Perform Same-Sex Marriages Hangs Hitler Picture In Courthouse

An Oregon judge who refused to perform same-sex marriage ceremonies is under investigation by the Commission on Judicial Fitness and Disability for accusations that he posted a portrait of Adolf Hitler in a Salem courtroom reports Yahoo! News.

Marion County Circuit Court Judge Vance Day is currently facing an ethics review after accusations surfaced that he selectively screened gay applicants and refused to perform their marriage ceremonies in addition to complaints directed at the judge for posting a picture of Nazi dictator Adolf Hitler in one of the courtrooms along with other ethics complaints.

However, a court spokesman for Day, Patrick Korten, says the picture was not posted to admire Hitler but to serve as a honor display for veterans’ service in World War II:

“We went to war against Hitler. His picture was there. It was not admiringly. It was him as the epitome of the enemy that we went to fight against.”

The picture in question is a collage submitted by the family of a World War II doctor, filled with memorabilia from the duration of the doctor’s service however, a large picture of Adolf Hitler unfortunately fills most of the frame. Day posted the collage without seeking permission and claims he didn’t know he needed pre-approval to post the collage.

Ok, I'm not going to make a big deal about the collage.

I thought it would be illegal to refuse.

It kind of implies he's homophobic. I'd probably tell him to piss off and go to someone more open-minded.
