    It's not clear to me why he refers to the State Courts having a "ministerial" responsibility in this matter. Isn't the correct term "magisterial"? Or perhaps the term should not be used at all, in favor of "judicial" or "constitutional".

    CBS NewsMeanwhile, news emerged for the first time this week that his son, Caleb Moore, pleaded not guilty on Dec. 21 to two counts, according to court documents.

    Moore, who is 25, faces charges of felony possession of the prescription medication alprazolam and misdemeanor marijuana possession.

    Caleb Moore was arrested in March in Troy. Police responding to a possible break-in said they reported smelling marijuana and finding Xanax. Caleb Moore pleaded guilty in 2013 and 2014 to separate misdemeanor charges of possession of drug paraphernalia.

    How typical -- another "Family Values" Republican who spends his life lecturing others on his own alleged moral superiority turns out to be a total failure as a father. Maybe he should spend his time trying to help his own criminal son be less of a burden on society?

    Just as then Alabama Governor George Wallace attempted to both physically and symbolically block black students from the University of Alabama in 1963, so too Moore is trying to stop the march of progress in LGBT rights. Like Wallace, Moore will lose too and history wil not be kind to him.

    As an aside, Wallace was a Democrat. My how the parties have changed!!

    Yes, back then many of the Southern Democrats were known as "Dixiecrats". A relic of post-Civil War Reconstruction, when northern Republicans were reviled in the Old South, and southern politicians flocked to the Democratic Party.

    But that began to change after the Black civil rights reforms of the 1960s, promoted by the national Democrats. Dixiecrats felt themselves betrayed and isolated. Republican Richard Nixon seized the opportunity with his Southern Strategy. Dixiecrats became Republicans, but their racism & bigotry live on. And now dominate the entire national Republican Party.

    Judge Moore is a confirmed incompetent and bigot. What's new?

    The implication is not so good for counties' finances in Alabama. By not agreeing to same-sex marriages, each county opens itself to federal lawsuits where huge attorney fees could (probably will) be awarded to the same-sex plaintiffs after they win.

    Alabama is one state I have never been to, and to which I have no plans ever to travel to. We should have left them out of the Union after the civil war (along with Mississippi).

    The chief justice of the Alabama Supreme Court, Roy Moore, is once again trying to ban marriages for gays and lesbians in his state, handing down an order directing probate judges to stop issuing licenses. But Moore is offering convoluted legal reasoning to mask his true belief: That only his God can decide who gets married

    And it's actually cowardly for Moore, who has proudly offered his true reasoning in the past: He doesn't believe the Supreme Court has the authority to hand down such decisions because the high court is subject to God's law, which he believes bans marriage for gays and lesbians.

    As I wrote last February when Moore halted marriages then, he told me all of this in a couple of interviews in years past.

    "Are laws themselves superseded by God?" I asked him in an interview on my radio program in 2011. "I think you're correct in saying that," he answered. "This is a Christian nation by the fact that 90% of the churches in America are Christian churches and it's certainly founded upon Christian principles. The supreme law of the land is the Constitution of the United States which recognizes many of those principles. Our freedom to believe what we want comes from God. When it comes from God, no man or no court, can take it away. That's a God-given right under the Declaration of Independence, which is law itself."

    A judge who makes the whole state look bad should be removed from the bench. How about an Executive Order from Obama to do that?

    That would be an executive order from the Governor of Alabama and I highly doubt that the current governor would muster enough courage to remove this narrow minded bible thumping screwball from the bench.

    That might be a correct statutory interpretation of Alabama law. But it poses serious constitutional issues about the government’s ability to deny couples access to a fundamental right. I asked Greg Lipper, an attorney for Americans United for the Separation of Church and State, whether he thought the judge’s stonewalling would pass muster. Short answer: absolutely not.
