http://abcnews.go.com/Politics/fbi-releases-anticipated-documents-heart-hillary-clinton-probe/story?id=41822909Newly released government documents show just how far FBI agents went to determine whether Hillary Clinton broke the law with her use of a private email server as secretary of state, even playing a trick on her during their three-hour interview with her in July...

...FBI Director James Comey recently said his agency could prove the presence of classified information in the e-mails but found no evidence to indicate that Clinton knew she was sending or receiving classified information — a conclusion reflected in the FBI documents released today...

...In addition, the paragraphs were not properly marked, lacking a header or footer indicating they contained classified information. But before their interview with Clinton, FBI agents placed the appropriate header on one of the emails to see how she would respond....

...Brian Fallon, the press secretary for the Clinton campaign, said, “We are pleased that the FBI has released the materials from Hillary Clinton’s interview...these materials make clear why the Justice Department believed there was no basis to move forward with this case.”

The FBI did an extraordinarily thorough job and it came up with NADA.

In fact, Republican FBI chief honcho James Comey has bent over backwards to please the Repubes in Congress. Historically and as a matter of long-standing practice, the FBI does not release any documents related to its investigation where the investigation does not result in a charge and/or prosecution. Here, the FBI has decided to release all kinds of documents which effectively violates Clinton's due process (5th Amendment) rights. Remember that these FBI reports contain the FBI's thoughts, characterizations and recollections, and nothing more. Indeed, the 302's used by the FBI reflect summaries of discussions, not transcripts (the FBI does not tape voluntary interviews so no transcripts are available).

Why is that violative of Clinton's due process rights? Well, if there were a charge, Clinton would be able to defend herself and have the ability to challenge in a court of law everything that the government alleges. For example, if there were a charging document or a complaint, Clinton would have an opportunity to file her answer. Here there's not a charge, so Clinton has no forum, other than the mainstream media and the social media, to defend herself. Indeed, this new approach will more than likely bite the FBI in the ass in future investigations because it has set a very bad precedent. From now on, the results of all FBI investigations (politically motivated or not, Republican- or Democrat-centric), regardless of whether a charge is recommended, will be subject to public disclosure. I can guarantee you that the Democrats will use the Clinton investigation as legal precedent when the tables are turned, so Repubes watch out.

The Repubes have tried unsuccessfully to milk this story a million different ways, and they will continue to do so, but you can't turn a dud into a weapon of mass destruction. Good luck with that.
