Dead Soldier Funeral Whacko Protestors Successfully Sued by Grieving Dad.

'Church members routinely picket funerals of military personnel killed in Iraq and Afghanistan, carrying signs such as "Thank God for dead soldiers" and "God hates fags."'

As much as I abhor the Phelps clan, I worry that this verdict may erode First Amendment freedoms.

If the catholic church can get away with claiming to be too broke to pay damages, these scum will probably never pay a dime.

The first amendment protects us from the government. Civil law cases have broader views and less clear application of the law. Its why OJ was found not guilty but still found guilty in a civil case.

The damages are what I think its whacked here. If a court allows this next you'll have anti-gay protesters wanting millions for witnessing a gay wedding.

No, I think the key here is the intent to incite hatred and emotional distress.

Good for the Father. I hope he can take their houses and the very clothes off their backs.

Except ITjock all your doing in being more a part of the hatred.

You don't punish the baptists by taking their money because they will just hate you all the more.

You solve issues by going up and talking to them, not shouting....talking.

    Trance 23 -

There are some people out there that will hate you no matter what.

You can talk all you want until you are blue in the face and drop from exhaustion, but they won't even listen to you.

In our society we have decided that there are two ways of punishing people. One of those ways is through tortious action. The tortfeasor can be held liable for their actions.

Intentional torts are any intentional acts that are reasonably foreseeable to cause harm to an individual, and that do so. Intentional torts have several subcategories, including torts against the person, including assault, battery, false imprisonment, intentional infliction of emotional distress, etc.

Regardless of the willingness or the ability of the feasor to change or atone for their actions, through Tort law they can be held liable for the pain they deliberately inflict on others.

I still say good for the father, its about damned time someone held Phelps and his brats liable for their intentional infliction of suffering.

I hope the courts seize every assett the church has.

All the families assetts are held by the church corporation.

Don't feel too bad for the innocent Phelps kids - three of them are attorneys who use the law as a weapon to punish those they disagree with.

This is simply good karma - payback can be a bitch.

The Phelps family is nuts and harmful. Let's hope they all just go away. Soon.

These people came here to my city when a family member of my co-worker died in Iraq. They had already made the news at that point for making such demonstrations elsewhere so a ton of veterans from the area were ready to support the family by barricading them during the funeral so they wouldn't have to deal with it. It was reported that they still could hear the yelling. That was the one time I've seen everyone agree on a gay related issue.

I think it was only a few weeks later that Indiana proposed a new law banning funeral protests. And I'm pretty sure it was passed.

I agree with paradox and trance, as much as I dislike the Phelps clan they should have free speech to express their point of view. The first amendment is seriously compromised through this lawsuit and I hope the ACLU comes to the defense of God Hates Fags.

If we limit one form of speech just because we simply don't like it or are offended next you know...

People will claim they don't want gay pride parades because they are offending by the "gay lifestyle"

    Stand up for all speech!

ITJock: as a writer, it drives me crazy when people quote other's work without attribution. You're quoting Wikipedia this go-round. How about learning to use quote marks and attribution?
