unauthorized ebay delivery, part II

    some of you guys may recall my previous thread about the window unit air conditioner that i returned, got credit for on my visa account, then was shipped another unit without purchasing it.....

    yesterday i emailed the ebay seller's website, trying to explain that they had shipped me ANOTHER air conditioner that i did not purchase or pay for...

    their email reply was that any return had to be pre-paid by the buyer!

    i try to do the right thing by notifying them of THEIR shipping error and they want ME to pay ($41.00!) to return THEIR mistake!!!! (this is what it cost me to return the first defective unit, was not reinbursed for returning it).

    i give up....i feel i have gone beyond normal circumstances trying to do "the right thing". icon_rolleyes.gif

    Monitor your account.
    Maybe the seller intends to bill you for the second shipment.
    (I didn't see your first thread)
    Even if you don't get re-billed, if nobody asks you to ship it back free-of-charge in a reasonable time, that 2nd one is yours, I'd say.

    I didn't read your earlier thread, but I would make sure and notify all parties involved in the transaction... including EBAY. I would not pay $41.00 to rectify their mistake. But notify all, keep copes of everything you send and
    monitor your account for any charges.... beyond that, I wouldn't use the air conditioner. Leave it in the box.

    You might choose a specific timeframe (90 days or even 6 months) and notify the parties again and tell them if you don't hear from them in 10 days, you are going to "dispose" of the air conditioner. What you then do with it is your own call.

    Two things:

    1) Are you still willing to purchase it?
    2) Did you tell them of any intention to purchase it as a replacement for the first unit?

    They may have thought you had full intentions of returning it like the first unit, even if the one you have now is fully functional.

    But meh! I agree, you've gone far beyond what's needed for the 'right thing'. I'd agree with what HndsmKansan said above. It doesn't sound like they're desperate to have it back anyway.

    Give detailed negative feedback on their account. That might get their attention. Even if they still try and screw you over, you might keep someone else from experiencing the same problem.

    Oh right, it's Ebay. Yes definitely negative feedback with the details, if you haven't already for their non-communication and having to go to Paypal arbitration the first time.

    Well yes, you tried, but I'm still not sure of the legal obligation.

    One thing I know for sure, if it gets to court, all bets are off. I should never have had to pay a contractor for work he swore he owed me, and that I would not have ALLOWED him to do had he hot said was already paid for. But a small claims arbitrator somehow said I did. So sense, and even the law, do not assure an outcome.

    Do they have any proof of delivery? I think you said the second one was left on your porch?

    Damn, I have absolutely no idea what you mean mch? Keep the a/c and keep fighting the cost of sending it back. Or of course to quote a previous danis.... Sell it on EBAY... icon_razz.gif
