Picture taken at a Night Club!

    Hey guys,

    Does anyone have a problem with having their pictures taken by the club photographer and promoters at a gay club and ending up in a website or a magazine. This recently happened to me> I was dancing with a friend and here we are on the site. Although, it was a nice pic but I get worried about what and where that picture may end up. My friend on the other end is a bit upset because is very discreet guy. Any thoughts?

    Actually we just had our picture taken this morning for one of the Fort Lauderdale gay rags, as we do all the time. But we're out, and know the photographer very well (Pompano Bill, for those from this area). But he always asks even us first, and so I think everyone else, too.

    I'm not sure what the rules are for a "public" place like a gay club, but I would think that given the problems gays can face about being outed, I believe a more careful policy should be followed for publishing any pics taken there.

    I've seen my pic taken, and then the gay rag allows people to"buy" pictures they take. That is totally wrong.

    They, of course, should be having you sign a waiver, for your picture to appear in the magazine. Without that, you can forbid them from publishing or selling it.

    Here in NYC when they snap shot you it's usually for HX magazine in the section Night out which shows the promotional parties of the week.

    The way the laws work for photos in public is you can legally take pictures of anyone as long as it is obvious that they are making themselves publicly available, and not trying to be private. However, if someone is standing on a street and you zoom into the prescription drug paper they have in their hand, or whatever, that is a breech of privacy.

    That being said, it does not give you the right to sell the photo. The photo can however be a part of a public viewing, like an art show. Like for instance, I sometimes take photos of hot county fair daddies. You like?

    I've taken photos at gay bars before (usually when some special event is going on), and people are usually pretty quick to let me know they do not want their photo taken... in which case I respect their wishes (no matter HOW hot they happen to be LOL)

    Depends. If I have the drunk face going on in the pic then I'm pissed and will show no mercy when I unleash my wrath. If I look hot in he pick, it's free marketing haha!

    Yeah, the general rule of thumb is that you can take pictures of anyone on public property. You don't necessarily need to get consent, as long it's for journalistic or creative purposes. But if you're planning to use someone's image specifically for profit, then you need to get a written consent.

    Just ask the website operator to remove the photo. They will most likely comply. Just be polite about it. But since the image is already on the site, then I'm sure a bunch of people have a copy saved to their computer by now.

    LMAO....thanks, MsclD.....I just wasted 30 mins looking at pics of people when I could probably get in my car and drive to Wally World and see it in person....LOL

    I'd read the website and or club's Terms of Service as well. Many larger nightclubs have "posted" notice that if you are photographed on the premises, they (the business) control copyright of any images for whatever use they like. Not necessarily for nefarious purposes, though there have been cases of clubs selling photos of strippers and dis-robed patrons to various sites and publications.

    True dat. My pictures were plastered all over gay rags in my youth all the time. I didn't mind then, and I don't care today...

    Call me old fashioned, but I don't like my picture taken by someone I don't know. I'm not even sure why I feel that way

    It took me a while to get comfortable putting my face pic on RJ

    I've been at gay bars, and someone will come along and start taking photos and I run for the hills. Sometimes I see people snapping pics at a dance club or other event.....I have no idea if I am being photographed because I am too occupied having a good time but still, I wouldn't like it.

    Last June, a total stranger came up to me while I was waiting for the subway and showed me a picture of me he had taken at a different location perhaps a month earlier and it creeped me out.

    I think if you just asked nicely, they would be removed. I do think it's in bad taste to post a picture of someone promoting a magazine or club without someone's permission. I've been in a local gay magazine twice and both times I was asked. Had I not been comfortable, I could have just stepped away.

    IT SURE IS! At first I thought it was one of those NY things ......but then I was just creeped out big time. I recognized me in his photo and I remember what I was wearing and where i was.....it was in a totally different part of town.

    I held my breathe for the next few weeks...always looking over my shoulder.............but nothing else happened.

    It happened to me and friends of mine all the time. I think it just comes with being there and having fun. The photographers that I knew always tried to get pics of young guys and regulars in the local gay publishings.
