This lawsuit is absolutely ridiculous. Imagine if a person applied to be a porn model, but said my reliigion doesn't permit me to pose nude, so he wants the porn company to accomodate his religious beliefs by permitting him to wear clothes. LOL This sounds stupid, but no more stupid than this woman who was denied employment because she wants to wear a scarf. She should not apply at a store like this if she is not willing to follow their dress code, just like a person should not be a porn model, if they aren;t willing to follow their no clothes policy., lol

I'm sorry, but nio company should be expected to hire anyone, if they are not willing to follow their companies dress code. Abercrombie's dress code does effect their marketing stragedy and employees shouold be expected to follow it and if you are not able to due to your religion or other reasons, than DON"T APPLY at a place where you are not willing to dress properly for the job or in the case of a porn model to be undressed. lol

All I can say is if a judge rules in her favor, our legal court system is really screwed up i n this country and they are contributing to our economic downturn with shit like this. We don't need another company to file banckrupcy over this kind of crap because stuff like this trickles down and affects all of us. If a big company like Abercrombie has to close its stores because of a ridiculous lawsuit like this, that affects all of us with higher prices or worse yet loss of jobs. It will even affect us at UPS because we do a lot of shipping for Abercrombie and we can not afford to have companies
like this go bankrupt over stupid lawsuits like this.

It even says in this article that they were sued because the employee wanted to dress more modestly. Well, I'm sorry. If you think its immordest to dress like they do at Abercrombie, then DON'T APPLY & WORK THERE.
That is part of the qaulifications of the job. And don't apply to be a porn model, if you don;t want to shoot nude. lol

Abercrombie & Fitch Faces Lawsuit Over Muslim Headscarf

Given the hyper-sexualized advertising that Abercrombie & Fitch has long embraced, it is no surprise that the company encourages its employees to let their hair down. But is the company practicing discrimination if it won't hire a young woman who covers her head for religious reasons? Yes, according to the Equal Employment Opportunity Commission. Last week the EEOC filed suit against Abercrombie on behalf of Samantha Elauf, a 19-year-old community college student from Tulsa, Okla., who is Muslim. The suit alleges that Abercrombie "refused to hire Ms. Elauf because she wears a hijab, claiming that the wearing of the headgear was prohibited by its Look Policy," or employee dress code. The suit says that Abercrombie "failed to accommodate her religious beliefs by making an exception to the Look Policy. These actions constitute discrimination against Ms. Elauf on the basis of religion."


Elauf, who had experience working in retail, interviewed for a position at a Tulsa Abercrombie Kids store in June 2008. During the interview, she wore a black hijab, or headscarf, in line with Muslim religious tradition. According to the EEOC, Elauf got word through a friend, who worked in the store, that the headscarf cost her the job. The EEOC alleges that during its investigation, Abercrombie & Fitch flatly told the agency, in a position statement, that "under the Look Policy, associates must wear clothing that is consistent with the Abercrombie brand, cannot wear hats or other coverings, and cannot wear clothes that are the color black." Elauf is suing for back pay and compensation related to emotional pain and anxiety. "If these allegations are true," says Chuck Thornton, deputy director of the ACLU of Oklahoma, "they are serious. In this day and age, it's not acceptable. Certainly, a headscarf is part and parcel of the Islamic experience." (Read "How to Reach Teens in a Recession? Ask A[a {e}]ropostale.")


When contacted for a response, Abercrombie & Fitch issued the following statement: "We cannot comment on pending litigation. We have a strong equal-opportunity policy, and we accommodate religious beliefs and practices when possible. We are confident that the litigation of this matter will demonstrate that we have followed the law in every respect."


Was Abercrombie & Fitch within its rights to enforce its dress code? Title VII of the Civil Rights Act of 1964 prohibits religious discrimination. "It shall be an unlawful employment practice for an employer to fail or refuse to hire .... any individual ... because of such individual's race, color, religion, sex or national origin," the law states. The key language, says Stewart Schwab, an employment lawyer and dean of Cornell Law School, is found in a 1972 amendment to Title VII. This amendment defined "religion." Abercrombie IS NOT discriminating against any religion because their dress code is enforced on ALL EMPLOYEES and this dress code is vital to the image and success of their company. The success of Abercrombie like a porn company depends on the sexual image they present. Can you imagine anyone suing a porn company because they were denied employment because their dick wasn't big enough or they weren't attractive enough? This lawsuit against Abercrombie is so ridculous. Abercrombie presents a sexual image and this is at the heart of thei company and success. Without that sexual image, the company will not survive.

If you are gonna grandstand before reposting an article, at least learn to spell and use some half-decent language skills. Otherwise we'll think you're just another dick-swinging adolescent who creates topics just to be validated.

I say let her wear the headscarf. It's part of her deeply held belief system. But she had better show her tits. It's part of the Abercrombie brand.

But if she has to take it off (appeals court, anyone?), she should just quit...and on her way out rip the cross from around the neck of the shaven twink working the door.

Abercrombie is more than just a local mall. They are nationwide and small companies like Abercrombie are the heatbeat of America. 75% of America's workers are employed by small companies. When they fail, it trickes down and we all fail.

There isn't a lawsuit filed in history that's brought down a company. Even the Big Tobacco lawsuits were a flea bite.

There are lots of reasons why Abercrombie and the like are in trouble, in fact far too many to list. But here are a few:

---Their stores are all in malls, and they have huge amounts tied up in leases which don't protect their losses but impose rent surcharges on high grosses.

---They sell exactly the kind of clothes that are the first to be cut from anyone's budget in a bad economy. Those $40 t-shirts are $15 elsewhere. This may not matter when times are flush. It matters hugely when they're not.

---They expanded too fast in the past decade, and have huge amounts of debt. Additionally, they added THREE other brand store chains (Abercrombie for kids, Hollister, Ruehl) and despite their claims, there is enough overlap that in some respects they are competing with each other for the same dollars.

---They are a fad. They aimed themselves at a market which is by its very nature fickle (teenagers and young adults) and it was inevitable that one day something that is kewl will be tomorrow's tragically un-hip.

Frankly, who gives a shit if they die.

And I don't know why you keep referring to Abercrombie as a "small" business. It's a huge national company. The small business that reportedly employ 50% of the workforce are under 75 employees.

This constant railing about lawsuits is just more Republican hogwash. They'd love to "tort reform" everyone completely out of their right to sue. Don't be misled: this isn't about any company's survival. It's about enriching their business pals. No company of any size has yet gone bankrupt because of an EEOC lawsuit.

The freedom we brag about includes the freedom to do stupid things. Most lawsuits are not frivolous; some are. So what? Assuming there is no merit, she'll lose. If it is deemed frivolous, she may be subject to 'loser pays' sanctions.

Well my coffin has already been sealed...

I've been an A&F employee for several years I was transferred to their new store Ruehl about 10 months ago...after about a year of overpriced clothes and overspending on "atmosphere," they've decided to shut all of the RUEHL stores down on the entire EAST COAST...meaning that come Jan 2010 I'll have to either try to get another transfer approved or just leave the company altogether

Paraphrased employee memo that we got:

We appreciate all of your hard work but come Jan, you won't have a job
