    Former Miss California Sued Over Breast Implants

    LOS ANGELES -- Former Miss California, Carrie Prejean, is being countersued over her breast implants.

    K2 Productions, which directs the Miss California USA pageant, is requesting the $5,200 it gave Prejean for her breast augmentation surgery. They're also seeking to throw out a portion of Prejean's lawsuit, specifically the portion dealing with public disclosure of private facts.

    "The alleged 'private facts' consist of her breast augmentation (which ceased being private during the swimsuit competition of the nationally-televised Miss USA pageant, in which Ms. Prejean walked the stage in a bikini)," the lawsuit states.

    The cross complaint also says, "Had [Carrie] heeded the guidance of the Gospel of John, who admonished only those who are without sin to cast stones in judgment, she might have avoided this legal battle ..."

    Prejean, 22, is suing California pageant executive director Keith Lewis, Shanna Moakler --who served as a co-director before she resigned in protest of Prejean -- and publicist Roger Neal, who handles press for Miss California USA and Lewis. She's accusing the group of libel, slander and religious discrimination.

    Prejean, who was stripped of her title in June, believes her crown was taken away because she said she opposed gay marriage. Pageant officials say she was fired for not fulfilling her obligations as Miss California USA and had missed several scheduled appearances.

    The suit also claims Lewis and Moakler both told Prejean not to mention God on her Miss USA application or at public events at least two months before she gave her anti-gay marriage answer.

    The lawsuit does not name Donald Trump, who owns Miss California USA's parent organization and who in May refused to fire Prejean, a decision he reversed a month later.

    Lewis said in a statement that their coutersuit is not about "financial reward" and that all profits awarded "will be donated to a charity that promotes the values of our organization."

    Prejean signed a book day in July with conservative book house "Regency Publishing" to publish a memoir called "Still Standing." She says she will tell her side of the story in the book, answering questions about what happened behind the scenes at the pageant and why she answered the question posed to her by Perez Hilton the way she did. The book will be released in November.

    I stayed in the hotel room adjacent to hers this August in Anaheim, the Hilton near the convention center.

    Forgot earplugs.

    As a law clerk who's had to respond to wacky motions, I have to say I'm not fond of using Biblical scripture in litigation proceedings. However, in this case, I think it is all too appropriate.

    They should've added something about the Golden Rule.

    In here speech to Value Voters she said "I'm disgusted by the intolerance shown to me, just disgusted". Funny, she hates the intolerance shown to her for making a completely intolerant statement. Now she's suing for religious discrimination? Poor Carrie, such a victim.
