    I don't think its technically illegal, its just not legal either. The Chinese government has largely disregarded the issue of gay rights as unimportant or just viewed it as not an issue to be dealt with, given all the other challenges the CCP faces on a daily basis.

    According to Wikipedia, after an official overhaul of the marriage law in 2003, same-sex marriage was brought up as an issue. This was dealt with in a press briefing where an officer stated that "same sex marriage is illegal in China" on August 19 2003.
