    Justice John Paul Stevens, one of the liberal members of the court, slated to retire now. Of course he felt it important to keep his seat "liberal" by having President Obama select his successor. Do you think it will be a "left" appointment (thus bringing on a fight with the republicans) or more moderate?

    Two minds here.. I think Obama needs a left member of the court. We certainly have several that are "far righties"....

    On the other hand, the repubs would certainly use the "left" appointment to make additional hay with the fall elections.

    I do think it interesting that Justice Stevens was appointed by President Ford, believing Stevens to be much more moderate.

    Currently one of the people I'm hearing the most about, Elena Kagan, would shift the balance rather significantly right on civil liberties and executive power, among other things.

    The thing to remember is that an actual left-of-center would preserve the current balance (unlike Alito replacing O'Connor). Stevens, though appointed by Ford in another age, has consistently voted for civil liberties, confining executive power, and separation of powers.

    I'm betting Leah Ward Sears, former Chief Justice of the GA Supreme Court, is a strong contender. The Court needs more women too.

    Hopefully President Obama will be able to appoint a moderately liberal/progressive judge to the US Supreme Court. I hope that this confirmation process is done just before the end of this year due to the possible fact that right wing republicans with help from those lunatic tea baggers gain more seats in Congress. We definitely need a moderately progressive/ liberal justice on the nation's high court.

    Stevens is a liberal, not a moderate one. just look at the major votes the court has taken over the years. If anyone is a moderate, it's Kennedy, and that should be preserved. Sorry that not all of us liberals believe the court should be a leftist court. Nor should it be a rightist one.

    Obama doesn't need to appease anyone. But the American people are distrusting him these days, and he needs to pick a mainstream judge, LIKE THEM. Doesn't have to be gay, hispanic, black, or anything that makes some people's legs hair stand up.

    Ironic in that Ford (a Republican) picked Stevens (a Republican) because he was extremely intelligent and was someone who as a judge was not particularly ideological and even handed/dispassionate in his judgements -- and it's probably safe to say that Stevens did that for his entire career.

    In truth there was any number of post WWII Republican judges who had similar judicial views to those held by Stevens.

    There are currently no leftist judges on the court. Stevens is considered a liberal, but he is not. the problem here is the court is not a centrist court is is currently run by conservatives, alito, scalia, thomas, roberts, and the swing vote Kennedy, who is not actually a moderate. There is some hope with Satomayor, but she is still a moderate. Stevens was appointed by a republican and while many say he has gotten more liberal over the years, that is hardly the case. In reality every judge appointed since something like 1971 has been more conservative than the judge they replaced with the possible exception of satomyor which now one really knows yet. Stevens is an incredible justice and was able to do amazing things for the "Liberal" wing of the court, this really is a big loss.

    I doubt Obama will appoint Leah Ward Sears. Because she's black, too many people would complain that he's playing racial favoritism. Plus, her close friendship with Clarence Thomas is public knowledge, and that won't help her.

    No I mean Obama shouldn't just pick a minority for the sake of him/her being a minority to appease that group of people.... a place where I fall too since I am one as well. He did that with Sotomayor and that was great, but it's time to move on. Of course if there is a gay or black person qualified, and I'm sure there are, then who am I to discredit them, but there will be no doubt in my mind and in many others of why he would really pick them.

    All the news pundits are saying Obama wants to pick someone with real life experience (as opposed to fake life experience?). For those of us who went to law school, I think it would be interesting to see how a Justice who is not legally trained would issue an opinion.

    A few things:

    1. If that's what you meant, then your previous post doesn't make that clear.

    2. Obama didn't pick Sotomayor just because she's a minority.

    3. Given the current makeup of the U.S. Supreme Court, and the current state of affairs in the U.S., many people would argue (I'm one of them) that it definitely is NOT time to go back to appointing straight, white, silver-spoon-fed white men to the U.S. Supreme Court. Are you for real?

    Stevens is a liberal only because the court has moved so far to the right that now he looks like a liberal. After all, he was appointed by Ford.

    Even near the end of his life, no one (except the insane) would have called Ford a liberal, yet he wrote in 2005, "I am prepared to allow history’s judgment of my term in office to rest (if necessary, exclusively) on my nomination 30 years ago of John Paul Stevens to the U.S. Supreme Court."

    Of course, Stevens's beliefs did move a bit to the left, but I think he was right when he said, as he did a number of times, that he had moved far less to the left than the court had moved to the right.

    good point - not sure what fake life experience is. no, i don't think he would appoint anyone who didn't have a law degree, but the question is would he appoint someone who hasn't been a judge -- and therefore someone who has less of a paper trail to be politicized in a confirmation hearing. for example, Elena Kagan has been mentioned as a possible nominee. she's never been a judge, but she's currently the Solicitor General and formerly the Dean of Harvard Law.

    does anyone know if any president has ever nominated someone w/out a law degree to the supreme court? I think Taft was also on the supreme court after he served as president. did he have a law degree? can't remember...
