    If she is gay, it would be a smart and very shrewd move on Obama's part to have nominated her...especially if her "sexuality" is to become even inadvertently an issue in the confirmation process. I don't think anyone in congress will even hint that this should matter, but it will be interesting to see how it unfolds.

    My question is, do Kagan and Janet Reno go to the same barber? icon_lol.gif

    Yeah. Her stance on executive privilege, indefinite detention, and late term abortion are of far more concern to me than whether or not she likes pussy.

    I don't know that it has actually been proven by anyone that Kagan is against Gay Marriage. What she has said is something like "there is no federal constitutional right to same-sex marriage". I believe she was merely pointing out the issue as related to the constitution now, not how perhaps she would like it to be. I do think her true opinion on the issue will be thoroughly vetted out during the confirmation process, and I suspect that she will be far more supportive of gay rights than not. Regardless, I'm far more concerned on her stance on many other issues that are of much more importance than gay marriage. I could care less is she is a lesbian or not.

    Yeah, her sexuality is irrelevant to me. I care about her positions, how she reasons, and so on.

    What's sad is that Obama does not have the stones to nominate someone who could be a liberal counterweight to the raging right-wingers Bush installed.

    This may be the last chance for Obama to make a mark on the supreme court that matters, given the likely results of the midterms.

    Instead, he elected to be a pussy, like on so many other fronts.

    I don't agree.
    I think she's a stealth candidate - just like Roberts and Alito.
    Roberts and Alito have turned out to be FAR more right-wing than they appeared to be during the confirmation process.
    Bush picked two guys who he knew are harshly far-right in their views, but who didn't have an extensive track record proving that - that could be used by the Dems to stop their confirmation.
    They LOOKED quite moderate, even though Bush knew that they're NOT.

    I have zero doubt that Obama has followed the same path, and has chosen someone who he's known for many years personally, and who he knows he can rely on to be a dependable progressive as a justice.
    But, she also doesn't have a lot of baggage that can be used to paint her as a left-wing extremist.
    Given the record she has of standing against anti-gay discrimination, I think gay Americans will be well represented by her on gay issues.
    She may be a centrist on some other issues - but nominating a centrist progressive does NOT make Obama a pussy.
    He is a centrist progressive too, and as president he has the right to pick someone he feels comfortable with.

    I've heard this subject discussed and I'm told she isn't a lesbian.... or at least she has never done anything to distinguish herself that way.

    Here in Chicago there was a bio and interviews with U of C people who knew her here in the paper today. There is no mention of a man now or EVER in her life. Just softball games between faculty and students. What a score for Obama, a Jewish Lesbian Supreme Court Justice !! Obama must surely KNOW what she is after all these years of being friends. I cant wait for the Senate hearings on this one. She is a stealth left candidate if there ever was one. I see no downside to this at all. Just Republicans who will be forced by their base to bring up the issue of her sexuality. Obama is smarter, or finally acting smarter than he has been so far and this is why I voted for him.( Oh and late term abortions are sort of a grisly process that as a society it might be best to avoid in any case).

    Republicans are not "gay bashers" they never have been. Give one instance. Most of them may be fairly conservative, but in no means gay bashers.
