I'm not Canadian but...I'm fairly certain you guys have SOME kind of self defense laws?

This whole this is totally infuriating because I know the same thing has happened here in the states.

This horrible, and just goes to show that hate crime laws are only as good as the will to enforce them. One thing that confuses me is this.

"Raynard says the question of whether the attack was a hate crime will go unanswered, too. No hate crimes charges were laid, and for the most part, Raynard is okay with that. "I think [the other assailants] intentionally chose to target queer people," he says, "but we're trying to downplay that as much as possible."

Yet when it happened his sister said publicly, "What happened that night was a hate crime," said Jackii Raynard. "They broke the whole left side of his face. His face speaks for itself."

    ?????????

    This is a weird case.

Hate crime laws exist because threats of violence against certain sections of the population not only damage the victims, but instills a sense of fear in the rest of that population. For that extra societal damage, perpetrators of hate crimes receive extra punishment.

If these teens specifically targeted these guys because they're gay, they definitely committed a hate crime. Just shouting anti-gay epithets during a fight doesn't immediately mean it's a hate crime, but it doesn't look like there's much dispute in this case. Poor guy.

I'm very confused as to why the victim doesn't want anyone to think it was a hate crime.
